On March 13, 2008, the EPA published a Direct Final Rule in the Federal Register at 73 FR 13441 which, among other things, adopts final accuracy margins for gaseous pollutants for use in the manufacturer-run in-use testing program for heavy-duty diesel vehicles. The Direct Final Rule also makes several changes to the in-use test program in the early years of testing. Please contact us for more details.
As this is a Direct Final rule, the rule will only take effect so long as EPA does not receive negative comments by April 14. Assuming no negative comments are received, the Direct Final rule will go into effect on May 12.
